Public Offer
1. General Provisions
1.1. [company name] (the “Provider”) offers any user of the tuk-tuk.am website (the “Customer”) to enter into a contract for the provision of paid services on the terms of this offer. This is a public offer within the meaning of Part 2 of Article 453 of the Civil Code of the Republic of Armenia.
1.2. The Customer accepts the offer (acceptance) by paying for a service, i.e. by topping up the wallet or by paying for a service from the balance using a button that expressly indicates payment (Part 3 of Article 454 of the Civil Code of the RA). The contract is concluded in electronic form (Part 3 of Article 450 of the Civil Code of the RA).
1.3. This Offer is published in Armenian, Russian and English. In the event of any discrepancy between the texts, the Armenian version shall prevail.
2. Services and Prices
- “Profi” plan for agencies, agents and developers: a listing limit, a discount on promotion and other features for the duration of the plan.
- Listing promotion: displaying a listing higher in search results and on the home page for the selected period.
- Advertising: banners, cards in the menu and partner articles in the “My Home” magazine — upon a separate request.
The scope, duration and prices of services are set out on the “Rates and Prices” page and are shown at the time of ordering. Prices are stated in Armenian drams [VAT included / not subject to VAT — to be confirmed once the tax regime is chosen]. The price is the same for all Customers.
3. Ordering and Payment
3.1. Before paying, the Customer sees the service, the period, the final price and the payment method. The payment button expressly indicates that placing the order entails an obligation to pay.
3.2. The contract is deemed concluded at the moment of payment. The order confirmation is displayed in the personal dashboard and in the transaction history, which can be saved; [once enabled — also sent by e-mail to the Customer].
3.3. The wallet on the Website is a prepayment for the Provider’s services. The balance cannot be transferred to another user or used outside the Website, and no interest accrues on it. [Procedure for refunding the unused balance — to be confirmed].
4. Service Periods
Promotion and plans are activated immediately after payment and remain in effect for the period specified when ordering. Advertising is placed within the time frame agreed in the request.
5. Withdrawal and Refunds
5.1. A Customer who is an individual not engaged in business activity (a consumer) has the right to withdraw from the contract within 14 days of its conclusion. The money is refunded within 14 days by the same method that was used for payment; the cost of the part of the service already provided is withheld.
5.2. If the consumer asked for the service to begin immediately and was informed that the right of withdrawal is lost once the service has been fully provided, no refund is made after the service has been fully provided.
5.3. If a listing is removed by a moderator or deleted, the unused part of the promotion is credited back to the balance in proportion to the remaining period.
5.4. For organisations and individual entrepreneurs: the unused wallet balance is refunded upon written application; promotion that has already started and advertising that has already been placed are non-refundable, except where the service was not provided through the fault of the Provider.
6. Advertising Requirements
6.1. The advertiser is responsible for the lawfulness and accuracy of the advertising (Law of the Republic of Armenia on Advertising). Advertising is placed in Armenian; any text in another language shall not be larger than the Armenian text and shall not contain information that is absent from the Armenian text.
6.2. Advertising of banking, credit and insurance services is accepted only from licensed persons; where an interest rate or the cost of credit is stated, the full annual effective interest rate must be indicated.
6.3. Partner materials and banners are labelled with the word “Advertising” and the name of the advertiser. The Provider may refuse to place advertising that violates the law or the Website Rules.
7. Liability
The parties are liable for non-performance of the contract in accordance with the legislation of the Republic of Armenia. The Provider is not liable for the outcome of the Customer’s transactions with other users.
8. Claims and Disputes
Claims are to be sent to [e-mail for claims]; the Provider will respond within 10 working days. A consumer has the right to apply to the authorised state body for consumer rights protection. Unresolved disputes shall be heard by a court of the Republic of Armenia.
